Terms of Service

These Terms of Service (“Terms”) govern your use of the Contrail iOS application (“Contrail,” “the App”), published by Alexander Verge, an individual (“we,” “us,” “the Developer”). By downloading, installing, or using Contrail, you agree to these Terms. If you don't agree, don't use the App.

These Terms supplement, and do not replace, Apple's own Licensed Application End User License Agreement, which also governs your use of any app distributed through the App Store.

01 What Contrail does

Contrail reads the date and location metadata of photos in your device's Photos library to automatically group them into trips and display them on a map, along with statistics about the places you've visited. See our Privacy Policy for detail on what Contrail accesses and how that information is used.

02 Eligibility

You must be able to form a legally binding contract to use Contrail. If you're using Contrail on behalf of a minor, you're representing that you have the authority to agree to these Terms on their behalf. Contrail has no way to independently verify age — the App Store's own age rating for Contrail is the relevant control here, not anything Contrail itself enforces.

03 Your photo library, your content

Contrail never claims any ownership over your photos or the data derived from them. See the Privacy Policy for detail on how your information is used. You're solely responsible for the content of your own photo library; Contrail simply reads metadata from whatever is already there.

04 License to use Contrail

Subject to these Terms and Apple's own license agreement, we grant you a limited, personal, non-exclusive, non-transferable license to use Contrail on Apple-branded devices you own or control, solely for your own personal use. You may not: reverse-engineer, decompile, or attempt to extract the source code of Contrail except as expressly permitted by applicable law; redistribute, sell, rent, or sublicense the App; or use the App for any unlawful purpose.

05 Automatic trip detection is not guaranteed to be accurate

Contrail's core feature — automatically detecting trips from your photo library — is a best-effort, algorithmic process. It can occasionally group photos into the wrong trip, miss a trip entirely, misidentify a country or city, or otherwise get something wrong. We do not warrant that Contrail's automatic detection, maps, or statistics are complete, accurate, or error-free. Contrail provides editing tools specifically so you can correct anything it gets wrong; using them is expected, not a sign of a defective product.

06 Disclaimer of warranties

CONTRAIL IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Contrail will be uninterrupted, secure, or error-free, or that any defect will be corrected.

07 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, arising out of or related to your use of, or inability to use, Contrail, even if we have been advised of the possibility of such damages.

08 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of Contrail or your violation of these Terms.

09 Termination

You may stop using Contrail at any time by deleting the app. We may modify, suspend, or discontinue Contrail, in whole or in part, at any time.

10 Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles, except to the extent superseded by federal law.

11 Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above will reflect any change. Continuing to use Contrail after a change means you accept the updated Terms.

12 Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with our Privacy Policy and Apple's own license agreement, are the entire agreement between you and us regarding Contrail.
